Don't get caught in the
1031 Exchange trap. What the 1031 Exchange companies fail to point
out is when using a 1031 you start, or continue, a real estate buying
cycle that has a deadline in many cases of 45 days to re-invest earnings.
You may only re-invest your earnings in real estate of like kind or
greater. You are always fully taxed on any money you do not buy real
estate with. Since the 1031 Exchange is only a "deferment" of taxes,
not a tax reduction program, eventually you will have to pay all of
the taxes you owe.
The Escrow Program utilizes
the IRS 351 Transfer. A C-Corporation in the real estate business is
not subject to any capital gains tax liability from the sale of Real
Estate. Instead, corporate gains are included with the rest of the corporate
income and therefore become part of the ordinary income of the corporation.
